On November 13th, in the cases covering the Energy Efficiency Rolling Portfolio Business Plans, the ALJ issued a proposed decision regarding third party solicitation process. If adopted, the decision would require a two-stage solicitation process to be performed by the IOUs: a Request for Abstract and a Request for Proposals. An independent evaluator would not be used, but rather procurement review groups would provide oversight. The proposed decision also would require standard contract terms to be reviewed by the Commission. This proposed decision is intended to cover third party issues so the utilities can move forward without a full decision on the rolling EE plans.
